Two bills, from the last session of the Illinois General Assembly, have become law. Public Act 94-0886 was enacted June 20 to provide that a condominium declaration and bylaws can require no more than a three-quarters vote of the unit owners to amend these documents. It was sponsored by Sen. Susan Garrett (D-Highwood) and Rep. Elaine Nekritz (D-Des Plaines). Public Act 94-1049 was enacted July 24 to provide financial relief for associations. It provides that a buyer of a condo unit at a foreclosure sale, other than a mortgage holder, or a purchaser who acquires title from the lender after a sale, must pay the association a sum equal to six months of past-due assessments before obtaining title to the unit. It was sponsored by Senators Garrett and Kwame Raoul (D-Chicago) and Reps. Nekritz and Kenneth Dunkin (D-Chicago). |
